Welcome to Weblium! Thank you for using our platform and entrusting your website to us.

Below, you may find Terms of Use applicable to White Label partners that have their Partner account on the Weblium website builder (hereinafter referred to as "Weblium White Label" or "Website”). These Terms of Use are part of the general Weblium Terms of Use, and you agree with them by signing up for the Weblium White Label.

All the products belong to JETIMPEX, INC, which is headquartered in the United States, Florida.

Please read these Terms of Use carefully. By accessing and/or using the Website and the Services provided on the Website (hereinafter referred to as “Services”), you express your consent to be bound, without limitation or qualification, by these Terms of Use. Those who sign up for Weblium White Label on behalf of legal entities shall represent and warrant that they have the authority to accept these terms on their behalf.

Nothing in these Terms shall be deemed to confer any third-party rights or benefits. If you disagree with any of these terms, please do not use this Website.

1. Using Weblium and Personal Information

1.1. Sign-up

To use the Services provided by Weblium White Label, you will be asked to create a user account (hereinafter referred to as “Account”). To use the Services provided by Weblium White Label, your Client also will be asked to create a Client’s account (hereinafter referred to as “Client’s account”). By signing up for Weblium White Label, you express your consent to provide us with accurate, complete, and updated information for your Account. This information may be used to contact you and to inform you of the latest updates and news related to Weblium White Label.

1.2. Personal Information

Please ensure that any personal information stored in your Account is safe from unauthorized use. Don’t provide third parties with information related to access to your Account, such as login and password. Please notify us immediately if you notice or suspect any loss, theft, or unauthorized use of your Account or password. You are responsible for any activity on your Personal and Partner Account on weblium.com. You are also responsible for any activity on your Account and your Clients’ Accounts on weblium.com. Thus, we are not liable for any acts or omissions by you concerning your Account and your Client’s Account.

Weblium White Label hereby reassures users of its Services that any personal information uploaded to the Account shall not be disclosed to third parties unless legal bodies claim the disclosure as a result of law infringement.

1.3. Minors

Children under 13 years of age are not permitted to use Weblium White Label, and children between 13 and 18 years old are not allowed to use the Website unless they have received permission from a parent or legal guardian.

2. Content

2.1. Users’ Intellectual Property

Subject to the Agreement between Weblium White Label and You, you shall own all the content you upload or create, including but not limited to texts, photos, images, music, videos, etc., unless the content is the property of Third Parties or has been uploaded from any publicly available sources.

2.2. Third-Party Intellectual Property

You may use Third-Party content, including, but not limited to, images, videos, fonts, and audio, on your website only after getting official permission or license from the content owner.
Unless manifestly permitted by the author or content owner, copying, storage, reuse, redistribution, publication, or any other form of abuse of copyrightable materials on the User's Website is prohibited.
If you fail to abide by the above regulations, Weblium White Label reserves the right to suspend your User Website for further investigation.

2.3. Content Guidelines

The following types of content are prohibited for publishing on Weblium White Label:
• Adult: pornography, use of pictures, videos, and other forms of media files containing nudity in a sexual context and/or exposed genitalia;
• Copyrighted Content: any content protected under Intellectual Property laws that you do not own the rights to;
• Black-Hat SEO/Spam Content: any content the primary purpose of which is to gain search engine rankings, likes, or provide irrelevant advertisements;
• Illegal Content: any sort of content that may infringe upon current legislation of the United States or other countries;
• Phishing: any sort of content that may induce users to provide their personal data for inappropriate use that may be harmful to them or illegal;
• Scams: dubious schemes (e.g., financial pyramids) that promise getting-rich-quick;
• Casino, gambling, and their promotion;
• Harmful Content: any content that may be harmful to the health of its users, for example, the one causing seizures;
• Illegal Products Promotion: content referring to the promotion or advertising of products the sale of which is prohibited or restricted under current legislation, including weapons, drugs, counterfeit goods, stolen items, and items that violate privacy rights or may be considered offensive.

Weblium White Label reserves the right to suspend or terminate any account involved in posting the types of content mentioned above. Also, Weblium White Label reserves the right to delete any files from websites (including files that are stored in a website's media gallery, even if they are not displayed on a published website) that violate the abovementioned Content Guidelines.

With Weblium White Label, you have 1 GB of storage, which is enough for publishing numerous images, videos, and texts on your site. If you want unlimited storage up to 5 GB or shrink your storage for the rest of your subscription plan, contact our support at .moc.muilbew%40troppus

2.4. Weblium Intellectual Property

Intellectual Property Rights. The Weblium website builder (hereinafter referred to as "Weblium" or "Platform”) retains exclusive ownership of the platform and all its associated intellectual property rights, including software and copyrights. This ownership extends even if Weblium integrates suggestions the Customer (hereinafter referred to as "Agency Partner" or "Builder-Builder Partner” or “Embedded Partner”) provides into the platform.

Builder-Builder Partner, Agency Partner, and Embedded Partner are prohibited from using, appropriating, replicating, or duplicating any marketing or other materials exclusively created and utilized by Weblium. These materials include email newsletters, photo-video-text content across all social platforms, and similar materials.

Builder-Builder Partner, Agency Partner, and Embedded Partner are strictly prohibited from price-dumping against Weblium.
Builder-Builder Partner, Agency Partner, and Embedded Partner explicitly acknowledge and agree not to utilize Weblium’s intellectual property. They also commit to refraining from plagiarizing any content or material Weblium produces.

Weblium and its Services are protected by Weblium's copyright, trademark, and other proprietary rights. Thus, any content provided by Weblium is protected by Intellectual property laws unless Users or Third Parties have uploaded it.

Unless manifestly permitted by Weblium, third-party authors, users, or intellectual property laws, copying, storage, reuse, redistribution, publication, or any other form of abuse of copyrightable materials shall be prohibited without referring to the initial source.

Nothing in the Weblium Terms of Use may be interpreted as waiving Weblium's Intellectual Property rights under any law.

2.5. Featuring Your Content

By using this Website, you agree that Weblium may use your completed User Websites or some portion thereof for Weblium promotional and marketing activities, e.g., by featuring them on our Website or in marketing campaigns.

If you do not want your website used for these purposes, please contact us at moc.muilbew%40troppus. We’ll remove it from any promotional or marketing activities run by Weblium.

3. Privacy

Weblium may require you to submit certain personal information that will be collected and used exclusively to use our Website. By using this Website, you agree to the collection and use of personal information, including processing and storage of such data in other countries and transfer between them by Weblium and its affiliates. Read the Weblium Privacy Policy to learn more about how we collect, store, and use your personal information and what measures we take to protect your privacy.

4. Service Fees

4.1. Purchases and Payments

With our free plan, all users may have free access to Weblium White Label. The Weblium Free Plan allows the creation of up to 3 websites in one account. When published, websites created with the Free Plan will be assigned a random .yourwebsite.life subdomain and will not contain Weblium branding.

Users can also buy a Pro subscription for a User Website, which allows them to connect a custom domain name, use analytics and marketing tools, secure their website with an SSL certificate, and remove Weblium branding.

The effective pricing and terms of Weblium White Label subscription plans are available on agency.weblium.com.

Weblium White Label's fees are firm and contain no hidden fees. If your bank account or account in the payment system of your choice has been debited with an amount higher than the fee listed on the Website, the difference might result from transaction fees or other fees required by your bank or payment system. You hereby agree that Weblium White Label isn’t in any way responsible or liable for additional fees arising from using bank or payment system services. Thus, in case of any deficiencies in the payment amount, please contact your bank or payment system.

Once your payment is confirmed, Weblium will send you a payment confirmation stating the amount due and your purchase details. A formal invoice from Weblium may be issued only on demand. If you want to receive it, please email us at moc.muilbew%40troppus.

In addition, your bank or payment system may send you any kind of payment confirmation. Unless stated otherwise, all the prices for Paid Services are listed in U.S. Dollars.

If auto-renewal payment for your subscription plan fails, ensure all these requirements are met.
Your card has sufficient funds to cover the payment.
Your credit card has yet to expire.
Your credit limit is sufficient to process the payment.
The payment details that you entered at checkout match your actual card information.

If all the requirements are satisfied, but payment attempts don’t stop, contact your bank or payment system to determine why the payment failed.

If you don’t solve this issue within ten days after the invoice due date, we’ll be obliged to cancel your subscription and suspend your site. Please authorize the needed payment yourself or contact our support at moc.muilbew%40troppus for more details.

For each client website created via the Embedded Partner’s White Label with the Weblium platform, a trial period of seven (7) calendar days is provided from the date of website creation. If a website is not deleted within this 7-day trial period, it will be deemed activated and subject to subscription fees.
Billing is calculated on a calendar-month basis. On the 2nd (second) day of each month, the Embedded Partner will be charged in a single transaction for all websites that were active at any point during the previous calendar month, regardless of their activation date.
The monthly fee is determined by the total number of websites that were active at any point during the billing month, regardless of the duration of such activity.
To avoid charges for a given website:
• Before activation: The Embedded Partner must ensure the website is deleted within the 7-day trial period.
• Before the next billing month: If the website is already active, it should be deleted before the end of the current calendar month to avoid charges for the next month.
Deletion can be performed via the Embedded Partner’s account dashboard or through the API.
The Embedded Partner is solely responsible for determining how to collect any corresponding fees from their clients.

4.2. Taxes

All fees listed at Weblium don’t include any applicable federal, national, local, or other taxes. All applicable taxes will be added to the fees for requested Services and indicated in an invoice you will receive upon payment confirmation for a particular Paid Service.

4.3. Weblium Pro Subscription Auto-Renewals

We use automatic subscription renewals for our Services to provide you with an uninterrupted and flawless experience with our Weblium White Label. Thus, you will be charged the applicable Fee for our Services for a renewal period equal to the original subscription period through the same payment method you used to make the original payment.

For example, if your original subscription period is one year, each renewal period will be one year. If you don’t cancel your subscription to Weblium Services, Weblium will automatically renew it when the previous subscription period ends and charge all the following applicable Fees.

4.4. Refund Policy

If you are not satisfied with the quality of Weblium White Label paid services for any reason, you may claim your money back within fourteen (14) days from the day of purchase (except for purchased domains that are not liable for refund).

If Weblium White Label has bought a domain name for you as part of the subscription plan and you claim a refund, Weblium White Label reserves the right to deduct the domain price from the refund amount. You may also request to keep a domain name that Weblium White Label bought for you on demand. Please state your intention to keep such a domain name while requesting a refund.

This provision does not apply to the following cases: (a) if you’ve failed to comply with our Content Guidelines, referred to in paragraph 2 above, or have been accused of breaking any laws with your content; (b) if you have purchased Third Party Services subject solely to Third-Party Terms and Conditions, which waive Weblium of any obligations or liabilities.

4.5. Fees Change

Weblium White Label fees may be changed at any time. You will be notified in advance of any fee changes. New fees will apply only to future payments. If you don’t agree to a Fee Change, you may cancel the subscription for a Paid Service at least 24 hours before the next payment date.

4.6. Chargebacks

If at any time after the purchase of a Paid Service, you or your client requests that the bank or credit card company reject, reverse or otherwise cancel the payment (hereinafter referred to as a “chargeback”), this will be considered a breach of the Terms of Use.

Chargeback is a procedure for challenging a banking transaction with which the client does not agree in order to receive funds back to his or her account.

Builder-Builder Partner and Agency Partner assume full responsibility for chargebacks initiated by your customers.

Builder-Builder Partner and Agency Partner commit to promptly contacting your client within three working days upon receiving notification via email from Weblium White Label employees regarding the chargeback. Within this timeframe, the owner of the White Label Builder-Builder account must respond to their personal manager from White Label (an employee of Weblium) explaining the client’s reason for the chargeback.

Builder-Builder Partner and Agency Partner acknowledge that you will not receive the amount of money for which a Client requested a Chargeback (the cost of subscriptions or other services lost due to the bank freezing funds) shall be deducted from the commission the owner of the White Label Builder-Builder account receives.

Builder-Builder Partner and Agency Partner acknowledge the obligation to cover any incurred fines from the bank for chargebacks, typically around $15, if the chargeback remains unresolved.

Builder-Builder Partner and Agency Partner agree that clients engaging in chargeback actions will face consequences, potentially resulting in their accounts, websites, and other Pro subscriptions being restricted or blocked for such actions.

Builder-Builder Partner and Agency Partner agree that their Accounts engaging in chargeback actions will face the consequences, potentially resulting in restricting or blocking their accounts, websites, and other Pro subscriptions.

Builder-Builder Partner and Agency Partner agree that to lift the block on your client account or their account due to a chargeback, the cardholder must cancel the request directly through the bank (or another payment method used for purchasing Weblium services, e.g., PayPal) and provide confirmation of the cancellation at .moc.muilbew%40troppus

If at any time upon purchasing a Paid Service, you contact your bank or credit card company asking to decline, chargeback, or otherwise reverse the payment due to Weblium, this will be considered a breach of your obligations, resulting in disabling or terminating your Account. Any data stored in such an Account may be removed permanently.

4.7. Fees for Third Party Services

Third-party Services purchased on Weblium or within the Weblium White Label account are subject to third-party refund and cancellation policies. The applicable policies can be accessed during the purchase process through the link to the terms and conditions of the purchase. We recommend you read them before purchasing, as we don’t guarantee refunds for Third-Party Services.

5. Permanent and Temporary Subscription Plans

5.1. Permanent Subscription Plans

Our permanent plans are annual Pro and Free subscriptions and Basic, Growth, and Enterprise plans. We reserve the right to change the price of these plans. We provide special seasonal discounts for permanent plans that we deliver on our official communication channels.

5.2. Temporary Subscription Plans

Temporary subscription plans are all the other plans created artificially to promote Weblium White Label services. These plans can be limited in time, available only for our partners, or presented on particular platforms.

Appsumo deal holders or other lifetime deal customers have discounts only on permanent subscription plans.

Special seasonal discounts that can be used to purchase permanent subscription plans don’t apply to temporary plans.

6. Cancellation Policy

6.1. Cancellation by User

You may delete your Account or cancel the Weblium White Label Subscription anytime by contacting our setup experts at moc.muilbew%40troppus. We will process your cancellation request and will terminate the Account within one (1) working day.

To avoid the next auto-renewal payment, we recommend disabling your Account or subscription at least 24 hours before the subscription expiration.

6.2. Cancellation by Weblium White Label

Weblium White Label has the right to suspend or terminate any Account or deny access to any of Weblium Services at any time due to the User’s failure to comply with our Content Guidelines, referred to in paragraph 2 above or when requested by the court or legal bodies in case of law infringement by the User.
To avoid your Account cancellation, you must also not frame, “page-scrape,” “deep-link,” mirror, and/or create a browser or border environment around Weblium White Label, except as expressly permitted in the written form and in advance.
If the User fails to comply with the Content Guidelines, we’ll notify them using the contact options provided in the User Account.
The Account may be renewed if the problem that caused the suspension or termination has been resolved or if the prohibited content has been removed from it.
Also, we reserve the right to suspend your Client's account and delete it after 4 weeks of the suspension date if there were no payments in their account and they have not used their accounts for 5 months and 7 weeks (which is approximately 6.5 months).
After 5 months without logging in to their accounts, your clients will get an email that their accounts will be deleted for inactivity soon. 
After 3 more weeks of inactivity (5 months and 3 weeks of inactivity in total), all the websites in the Client's account will be suspended. It is done to draw the Client's attention to the issue in case they did not see the email notification.
After 4 more weeks of inactivity (5 months and 7 weeks of inactivity in total), an inactive client's account and all the websites there will be permanently deleted. To prevent accounts from being deleted, clients should just sign in to their accounts to show that they are still interested in the website builder's services. If they make any purchase in their account, the account will not be auto-deleted even after a long period of inactivity.

7. Third Party Services

Weblium White Label may provide several Third-Party Services, such as domain registrars, website-building tools, applications, and design services.

Regarding Third-Party Services, Weblium White Label acts solely as an intermediary and is not responsible or liable for Services provided by Third Parties. Thus, Weblium White Label will not be involved in any transaction, communication, or other interaction with Third Parties.

Weblium White Label may recommend using certain third-party services for better user experience and/or as part of the extension of Weblium White Label. You hereby agree to use Third-Party Services exclusively at your own risk. Any services rendered in such a manner shall be subject to the legal terms stipulated by Third-Party Terms and Conditions. We recommend reading them carefully before engaging in any activity with Third Parties.

8. Limitation of Liability

Under no circumstances shall Weblium White Label, its officers, directors, shareholders, employees, affiliates, and/or agents be liable for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages resulting from (a) any aspect of your use of the Website, whether the damages resulting from use or misuse of the Website, from failure to use the Website or the interruption, suspension, modification, alteration, or termination of the Website, (b) use of any Services or products obtained through or advertised in connection with the Website or any external links on the Website, (c) use of any information or advice obtained through or advertised in connection with the Website or any external links on the Website, (d) errors, mistakes, or inaccuracies of or in any content, (e) events beyond the reasonable control of Weblium. These limitations shall apply to the fullest extent permitted by law.

9. Law and Jurisdiction

To the maximum extent permitted by law, this agreement is governed by the Laws of the United States of America and state laws of Florida. You hereby consent to the federal or state Courts of Florida, US, being the exclusive jurisdiction and venue of courts in all disputes arising from or relating to using the Weblium White Label Website and/or Services.

In case of any disputes arising from using Weblium White Label and/or its Services, we will take any measures to resolve the dispute amicably. You hereby agree to try to resolve a dispute by first contacting us via moc.muilbew%40lagel. We'll resolve the dispute informally by contacting you via email, phone, or other means of communication. Failing to resolve the dispute within thirty days of receiving your first notification outlining the problem, the case may be referred to the federal or state courts of Florida, US.

10. Changes and Updates

Weblium White Label may occasionally change and update these Terms of Use and undertakes to post the most current version on the site. If a change or update limits your rights or options in any way, we’ll notify you thereof as soon as possible. The notice will stipulate a period after which the new terms will come into force but not earlier before new Terms of Use are published on the Website. Neither changes nor updates will ever apply retroactively. By continuing to access or use the Website and/or any Services rendered by Weblium White Label after any changes or updates become operative, you agree to be bound by new Terms of Use. Should you disagree with our changes or updates, please cease to use the Website and its Services.

11. Notices

We may send you relevant notices using one of the following methods: (a) via the Weblium Services, including by a banner or pop-up, push notification within the Weblium Website, Account or elsewhere; (b) by e-mail, sent to the e-mail address you provided us; and/or (c) by phone numbers provided in your Account; (d) by letters sent to physical addresses that you provided in your Account; (e) using any other ways of communication available in your Account.

Weblium White Label notice to you will be considered received and operative within twenty-four (24) hours after it was sent or published in any of the ways mentioned above unless the notice indicates otherwise.

These Terms of Use were originally written in English (US). We may eventually translate them into other languages. The latter shall prevail if a translated version conflicts with the English version.
